A NOTICE FROM THE DEPARTMENT OF ELEMENTARY AND SECONDARY EDUCATION,
Notice of Public Comment, Proposed Regulations on Notification of Bullying
or Retaliation, 603 CMR 49.00 — Comments due August 25th.
Pursuant to its authority under M.G.L. c. 69, § 1B, c. 71, § 37O, as added
by Chapter 92 of the Acts of 2010, and in accordance with the Administrative
Procedure Act, M.G.L. c. 30A, § 3, the Massachusetts Board of Elementary and
Secondary Education is soliciting public comment on the proposed Regulations
on Notification of Bullying or Retaliation, 603 CMR 49.00.
Chapter 92 of the Acts of 2010, An Act Relative to Bullying in Schools,
directs the Board of Elementary and Secondary Education to promulgate
regulations related to a principal’s duties in addressing bullying
prevention and intervention, specifically:
• notification to the parent or guardian of the victim and the perpetrator
of a report of bullying or retaliation and of the action the school will
take to prevent further bullying, and
• notification to law enforcement of bullying or retaliation, when the
perpetrator’s conduct may result in criminal charges.
In addition to notification, the proposed regulations address
confidentiality of student record information related to notification of
bullying or retaliation.
